Terms of Use

1. Purpose of the application

The application enables users to create a dynamic GIF countdown timer that can be embedded in an email or newsletter.

2. Use and restrictions

Use of the application is only permitted within the scope of applicable laws and these terms of use. The following are expressly prohibited:

  • Misuse of the application, including automated or mass requests (e.g. through bots or scripts).
  • Sending spam, in particular embedding the countdown timer in unsolicited or unauthorised mass emails.
  • Deceptive or fraudulent use, e.g. to manipulate deadlines or to falsify information.
  • Use in connection with illegal or harmful content, including but not limited to:
    • Hate speech, discrimination or glorification of violence.
    • Fraudulent offers or phishing attempts.
    • Distribution of malware or viruses.
    • Violation of data protection rights or intellectual property of third parties.

The operator reserves the right to restrict or block access to the application at any time if violations of these rules are detected.

In addition, the principle of fair use applies. Users undertake to use the application only to an extent that corresponds to normal and reasonable use. Excessive, abusive or automated use may result in restrictions or blocking of access.

3. Warranty and disclaimer

Use of this application is at your own risk. We do not guarantee the constant availability, accuracy or security of the application. In particular, we are not liable for data loss, technical malfunctions or damage resulting from the use of the application, unless they are based on intent or gross negligence or result in injury to life, limb or health.

This application is provided free of charge and without any guarantee of specific functions or permanent availability. We reserve the right to change or discontinue content or functions at any time without prior notice.

We accept no liability for damage caused by malware or other harmful programs, unless this was caused by us intentionally or through gross negligence.

If you are dissatisfied with the use of the application, you can terminate it at any time. Mandatory legal rights, in particular as a consumer, remain unaffected.

4. Data and data protection

The application only processes the user's email address to verify the countdown timer. In addition, when the countdown timer is accessed, the user's IP address is processed for a short period of time to prevent excessive requests and ensure the security of the service. This measure is carried out in accordance with Art. 6 (1) lit. f GDPR, and the IP address is not stored permanently. No other personal data is stored or analysed. 5. Payments and fees

The application is currently free of charge.

6. Changes to the Terms of Use

We reserve the right to change the Terms of Use at any time. Changes will be published on this page.

7. Termination and blocking

The operator may restrict or terminate access to the application in the event of misuse or violations of these terms and conditions.

8. Legal provisions and place of jurisdiction

  • German law applies.
  • Place of jurisdiction: Berlin.

9. User responsibility

Use of the application is at your own risk. Users are responsible for complying with applicable legal provisions, in particular data protection regulations. This also includes the correct integration of the countdown timer in an email or newsletter and, if necessary, providing the recipients with the required information.

10. Beta status

This application is in beta phase. This means that features may still change and may not work flawlessly at times. We strive to ensure stable use, but do not guarantee the unrestricted availability or flawlessness of the application. We are continuously working on improvements and welcome your feedback!
